Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Hydra (“the Service”), operated by Hydra (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Hydra is a hosted multi-domain email workspace. The Service allows you to receive, send, and manage email across multiple custom domains from a single unified inbox. The Service includes a web application, background email processing workers, and a REST API.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at hello@hydra.mx of any unauthorized use of your account.

4. Acceptable Use

You may use the Service to:

  • Send and receive lawful email on domains you own or are authorized to use
  • Manage personal projects, side businesses, freelancing, SaaS applications, newsletters, and other legitimate communications
  • Use the API to send transactional and conversational email from your applications

You may not use the Service to:

  • Send unsolicited bulk email (spam), phishing messages, malware, or any form of harassment
  • Send email to recipients who have not given consent to receive it, including purchased, scraped, or harvested email lists
  • Transmit content that is illegal, fraudulent, defamatory, obscene, or that infringes on the intellectual property rights of others
  • Impersonate another person or entity, or falsify email headers or sender information
  • Use the Service for cryptocurrency promotions, multi-level marketing schemes, or similar activities
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Service
  • Interfere with, disrupt, or overload the Service or its infrastructure, including through denial-of-service attacks or automated abuse
  • Use domains you do not own or are not authorized to use

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account. We will make reasonable efforts to contact you before taking action, except where your activity poses an immediate risk to other users or the Service's email-sending reputation.

5. Domain Ownership

By adding a domain to the Service, you represent and warrant that you own or have authorization to use that domain for email. We verify domain ownership through DNS record publication (MX, SPF, DKIM). We reserve the right to remove domains that we reasonably believe are being used without authorization.

6. Intellectual Property

Your content: You retain all rights to the content you send, receive, and store through the Service. By using the Service, you grant us a limited, non-exclusive license to host, process, store, and transmit your content solely as necessary to operate and provide the Service.

Our service: The Service, including its design, code, features, and documentation, is owned by us and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

7. Pricing and Payment

  • Free tier: The free plan is available indefinitely with the limits described on our pricing page. We reserve the right to modify free-tier limits with 30 days' notice.
  • Paid plans: Paid subscriptions are billed monthly or annually, at your choice. Annual billing provides a 20% discount. Prices are listed on our pricing page and are subject to change with 30 days' notice.
  • Storage overages: If your storage usage exceeds your plan's allocation, overage charges of $2 per 10 GB will apply. Email delivery is never interrupted due to storage overages — we bill the overage and notify you.
  • Refunds: If the Service is materially defective or unavailable due to an issue on our end, we will issue a prorated refund for the affected period. All other refund requests are handled on a case-by-case basis.

8. Cancellation and Data Export

You may cancel your subscription at any time through the billing management portal. Upon cancellation:

  • Your account remains active until the end of the current billing period
  • After the billing period ends, your account reverts to the free tier
  • You will have a 30-day data export window during which you can download all messages as standard .eml files
  • After the export window, data associated with domains exceeding the free-tier limit may be deleted
  • We will never hold your data hostage or delete it without notice

9. Service Availability and Support

We strive to maintain 99.9% uptime but do not offer a formal Service Level Agreement (SLA) at this time. Scheduled maintenance windows will be announced in advance. Current system status is available at /status.

Support is provided via email at hello@hydra.mx. Pro plan subscribers receive priority support with faster response times.

10. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in the Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hydra and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be announced via email to all registered users at least 30 days before they take effect. Your continued use of the Service after such changes constitutes acceptance of the revised Terms. The “updated” date at the top of this page reflects the most recent revision.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with the Privacy Policy and any applicable plan-specific terms, constitute the entire agreement between you and Hydra regarding the Service and supersede all prior or contemporaneous communications, whether oral or written.
